Eligibility

General Eligibility

Eligibility Criteria for Service Providers
To become a registered service provider on Zowfity, the following conditions must be met:

-KYC Verification: Completion of Know Your Customer (KYC) verification is required, including submission of a valid government-issued ID, proof of address, photograph, and a verified mobile number. Zowfity reserves the right to reject or cancel registration if any KYC information is found to be false, incomplete, or unverifiable.
-FSSAI License (for Food-related Services): Service providers offering food-related products or services must hold a valid FSSAI License in accordance with the Food Safety and Standards Act, 2006. A copy of the license must be uploaded during onboarding, and any lapses in validity may lead to deactivation of such services.
-Skill & Experience Declarations: You may be asked to provide documentation or declarations of your expertise, training, or certification, depending on the category of service (e.g., electrical, plumbing, or beauty services).
Code of Conduct: All service providers must operate ethically and professionally. Misconduct, harassment, misrepresentation, or any form of illegal activity is strictly prohibited.
Eligibility Criteria for Company Partners and Agencies
If you are registering on behalf of a partnership firm, agency, or private limited company to offer services on the Zowfity platform, you must comply with the following:
Legal Registration: Your business must be legally registered under relevant Indian statutes (e.g., Companies Act, Partnership Act, or relevant MSME regulations).
Labour Compliance: If your company employs workers for service execution, you must comply with labour laws in India, including but not limited to the Labour Laws (Exemption from Furnishing Returns and Maintaining Registers by Certain Establishments) Act, 1988, and other applicable State-level regulations. You may be asked to submit proof of registration under the Shops and Establishments Act, EPF, ESIC, or contractor licenses, where applicable.
GST Registration: If applicable, you are required to provide a valid Goods and Services Tax (GST) registration number.
Authorized Representation: The individual registering the business account on behalf of the company must have appropriate authority and documentation to act on behalf of the business entity.
Right to Refuse or Terminate Access
Zowfity reserves the absolute right, at its sole discretion, to refuse, suspend, limit, or permanently terminate access to the Website and Services to any user, service provider, vendor, or company partner under the circumstances described below. These actions may be taken with or without prior notice, depending on the nature and severity of the issue.
Access may be denied or revoked under, but not limited to, the following circumstances:
Violation of Terms: Breach of any clause within these Terms and Conditions, the Privacy Policy, Refund and Cancellation Policy, or any other applicable policy.
Non-compliance with Indian Laws: Any activity that violates applicable Indian statutes including, but not limited to, the Information Technology Act, 2000, Indian Penal Code, 1860, Consumer Protection Act, 2019, Food Safety and Standards Act, 2006, Labour Laws, and other relevant regulations.
Failure to Complete or Falsify KYC: Submission of false, misleading, outdated, or incomplete KYC or regulatory information.
Unprofessional or Unsafe Conduct: Repeated customer complaints, substandard service delivery, misconduct, harassment, or behavior deemed inappropriate by Zowfity’s internal assessment team.
Use of Platform for Illegal Purposes: Any use of the Website or Services for fraudulent, deceptive, unlawful, or unethical practices.
Violation of Age or License Requirements: Ineligibility due to age (below 18 years), lack of FSSAI license (for food providers), or non-compliance with labour licensing and tax registrations (for company partners).
Intellectual Property Infringement: Unauthorized use of Zowfity’s brand, logo, content, software, or proprietary tools.
Security Threats: Activities that pose cybersecurity risks, including hacking, phishing, data scraping, or the dissemination of malware or viruses.
In cases of serious misconduct or illegal activity, Zowfity reserves the right to:
Report the incident to relevant law enforcement or regulatory authorities such as:

Cyber Crime Cell or Police
While Zowfity may choose to communicate the reason for account suspension or termination, we are under no legal or contractual obligation to disclose specific reasons or evidence to the affected user. This is necessary to maintain platform integrity and prevent abuse of investigative procedures.
In certain non-critical cases, affected users may write to zowfitysupport@zowfity.com to request a review or clarification regarding the suspension or termination. However, the final decision rests solely with Zowfity’s internal compliance team and is binding.

Zowfity does not guarantee the availability of any particular service or product at all times or in all geographic areas. Users are advised to check the Website frequently for the most current service listings, categories, and provider information.
Payment Terms and Pricing
Dynamic Pricing: The prices for services and products listed on the Zowfity platform are subject to change based on market conditions, location, service availability, provider rates, seasonal fluctuations, and demand. Zowfity reserves the right to adjust pricing at any time without prior notice.
Inclusive/Exclusive of Taxes: Unless otherwise stated, all prices listed are exclusive of applicable Goods and Services Tax (GST) and other applicable statutory taxes. The final amount payable will be displayed during checkout, inclusive of all applicable taxes in accordance with the Goods and Services Tax Act, 2017.
Estimates and Final Quotes: For certain services (e.g., home repairs, electrical work), prices listed may be indicative and subject to revision upon site inspection by the service provider. Final quotes will be communicated to the user before service commencement.

All online payments are processed through secure, RBI-compliant third-party payment gateways. Zowfity does not store full card details or CVV codes in accordance with RBI and PCI DSS (Payment Card Industry Data Security Standard) guidelines.
Users agree to pay the full amount for the selected product or service at the time of placing the order or booking the service, unless otherwise agreed upon in writing.
In the event a user fails to make timely payment, Zowfity reserves the right to cancel the booking, suspend the user’s account, or withhold delivery of service or product.
Service providers and sellers on the Zowfity platform are not authorized to demand or accept payment outside the Zowfity payment system unless expressly permitted in writing.
Upon successful payment, Zowfity will issue a GST-compliant invoice or receipt via email or in the user dashboard.
If a service provider is a registered business, the invoice may be generated by the provider in accordance with Indian tax laws.
All invoices will include itemized charges, applicable GST, and total amount paid .
Zowfity has a separate Refund and Cancellation Policy, which outlines the conditions under which users may be eligible for a refund.
Refunds, if approved, will be processed to the original mode of payment within 5–10 business days.
In case of failed or partial service delivery, users must raise a complaint within 48 hours to be eligible for refund or re-service evaluation.
Any payment dispute, including overcharging, unauthorized charges, or failure to receive a refund, must be reported to zowfitysupport@zowfity.com
within 7 business days of the transaction.
Zowfity will investigate the matter and resolve it in accordance with RBI norms and internal service protocols.
In the event of a chargeback (forced reversal of payment by the bank), Zowfity reserves the right to temporarily suspend the user’s account, block further transactions, and pursue legal action or recovery under the Indian Contract Act, 1872.
All payouts are subject to TDS (Tax Deducted at Source) as per the Income Tax Act, 1961 and may require submission of PAN and bank account details.
Zowfity reserves the right to withhold or delay payouts in the event of a dispute, service failure, fraudulent activity, or regulatory compliance concerns.
Cancellation, Refunds, and Rescheduling
Booking Policy
Advance Booking Requirement: All service bookings must be made at least 24 hours in advance of the intended service time to allow for proper scheduling and assignment of service providers.
Bookings made less than 24 hours in advance may not be guaranteed and are subject to availability and approval.
Cancellation Policy
Free Cancellation Window: Users may cancel a confirmed service booking within 6 hours of making the booking to be eligible for a full refund.
Cancellations made after the 6-hour window or within 4 hours of the scheduled service time will not be eligible for a full refund, and a cancellation fee of up to 50% of the service value may be charged to compensate the service provider for loss of opportunity and preparation costs.
Cancellations must be made through the Zowfity platform (website or app). Phone, email, or third-party cancellations will not be considered valid unless confirmed by our support team.
Frequent cancellations by the same user may lead to temporary suspension or permanent account restriction at Zowfity’s discretion.
Refund Policy
Eligible refunds will be processed within 5–10 business days to the original method of payment.
Refunds may be subject to deduction of payment gateway fees, cancellation charges, or taxes already remitted to the government.
Zowfity reserves the right to deny refund requests in cases of:
False or malicious complaints
Misuse of promotional codes
Violation of the Terms and Conditions or any fraudulent activity

Rescheduling Policy
Users may reschedule a service within 2 hours of the original booking time, provided the new requested time slot is available and feasible for the assigned service provider.
Rescheduling requests made after the 2-hour window may be treated as a new booking and subject to additional charges.
All rescheduling must be done through the official Zowfity platform. Any verbal or informal agreement with a service provider will not be recognized unless reflected in the system.
Service Provider No-show or Cancellation
If a service provider fails to show up or cancels the service without a valid reason, users will receive a 100% refund and may be offered a reschedule at no additional cost.
Zowfity may impose penalties or remove the provider from the platform for repeated no-shows.
Exceptional Circumstances
In the case of emergencies, natural disasters, government orders (e.g., lockdowns), or unforeseen technical issues, Zowfity reserves the right to cancel, reschedule, or delay services, and users will be informed promptly. In such scenarios, users will not be charged cancellation fees and will be offered alternative solutions, including rescheduling or full refund.
User Conduct and Obligations
You agree to:

Not interfere with or disrupt the Website’s operation, servers, or networks.
Respect the rights of Service Providers and other users and refrain from harassment, exploitation, or discriminatory conduct.
Cooperate fully with Zowfity in investigations of violations of these Terms.
Intellectual Property Rights
All intellectual property rights in the Website and its content, including but not limited to trademarks, service marks, copyrights, patents, and database rights, belong to or are licensed to Zowfity.

All services and goods listed on the Zowfity platform are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to:
Fitness for a particular purpose
Merchantability
Non-infringement
Accuracy or completeness of information
Continuous availability or error-free operation
Zowfity does not guarantee:
The quality, safety, legality, or suitability of any service or product
That the services will meet your expectations or requirements
That any provider, seller, or buyer will perform their obligations without default
Service Provider and Seller Responsibility
All service providers and sellers listed on the platform are independent contractors, and not employees, agents, or representatives of Zowfity. We do not control or assume responsibility for:

Delays, cancellations, negligence, or substandard service delivery

Platform and Technical Limitations
Zowfity does not warrant that:
The platform will operate without interruptions, delays, or technical errors
Data transmission will be secure, virus-free, or error-free
All listings, prices, or availability data are current at all times
Although we implement industry-standard cybersecurity practices, we are not liable for damages resulting from unauthorized access, hacking, or data breaches beyond our reasonable control.
Limitation of Liability

Fraudulent, Illegal, or Unethical Conduct: Engaging in deceptive, illegal, or unethical activities such as providing false documentation, misrepresenting services/products, or defrauding users.
Repeated Cancellations or No-shows: Frequent failure to fulfill bookings without valid reasons.
Misuse of the Platform: Use of the platform to harass, spam, scam, abuse, or exploit other users or service providers.
Security Threats: Any activity that poses a threat to the platform’s cybersecurity, user data, or infrastructure integrity.
Government or Legal Order: Compliance with lawful government orders, judicial mandates, or law enforcement investigations.
User Complaints and Negative Ratings: Repeated negative feedback from customers, supported by internal investigations.
Non-compliance with Regulatory Requirements:
Service providers under 18 years of age
Failure to obtain and provide a valid FSSAI license for food-related sales

Effects of Suspension
If your account is suspended:
You may be restricted from accessing the platform, listing services, accepting bookings, or receiving payments.
Existing orders may be put on hold or cancelled.
Pending payouts may be delayed until the matter is resolved.
You will be notified via your registered email or phone number regarding the reason for suspension.
Suspension may be lifted upon resolution of the underlying issue to Zowfity’s satisfaction.
Effects of Termination
If your account is terminated:
Your access to the platform and all associated services will be permanently revoked.
All pending orders and services will be automatically cancelled.
All remaining balances (if any) may be withheld or forfeited, subject to legal liabilities, outstanding disputes, or evidence of fraud.
Zowfity reserves the right to report unlawful activity to appropriate legal or regulatory authorities, including police and cybercrime units.
Voluntary Termination

Clearance of any outstanding dues or disputes

Right to Refuse or Restrict
